US Judge Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal detention.

In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The legal challenge center on disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
